1. Acceptance of Terms

Welcome to VeMark. By using our website, mobile app, or any related services (collectively, the "Service"), you confirm that you have read, understood, and agreed to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

2. Description of Service

VeMark is a location-based memory app: you can leave "footprints" (mood, text, photos) at any location and interact with other users (likes, comments) within 1 km of that spot. We may add, modify, or discontinue features at any time without prior notice.

3. Accounts & Eligibility

Some features (commenting, liking) require signing in with a Google account.
You must be at least 13 years old and legally capable of entering into these Terms.
You are responsible for all activity under your account; keep your credentials secure.

4. User Content

You retain ownership of the text, photos, and moods you upload ("User Content"). To enable the Service to function (e.g. showing your footprint to nearby users), you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to store, reproduce, display, and transmit such content, solely for the purpose of operating the Service.

You warrant that you have the right to upload the content and that it does not infringe any third party's rights (including copyright, publicity, or privacy rights).

5. Prohibited Conduct

You agree not to:

Post unlawful, harassing, hateful, sexual, violent, or defamatory content;
Spoof your location or impersonate another person;
Reverse-engineer, scrape, automate excessively, or otherwise interfere with the Service;
Collect personal data of other users without their consent;
Engage in any activity that could harm the Service or other users.

We reserve the right to remove content, suspend or terminate accounts, and pursue legal remedies for violations.

6. Intellectual Property

The VeMark name, logo, design, software, and all non-User-Content materials are owned by us or our licensors and protected by copyright and trademark laws. Except as expressly granted in these Terms, no rights are granted without prior written consent.

7. Third-Party Services

The Service integrates third-party services such as Google Sign-In, Google Maps Platform, and S3 storage. Your use of those services is also subject to their own terms and policies.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or that location information will be perfectly accurate. You understand that GPS data may vary based on device, network, weather, and other factors, and any decision relying on it is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, the Service and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages. Our aggregate liability to you shall not exceed the amount you paid to use the Service in the past 12 months, or US$100, whichever is greater.

10. Termination

You may stop using the Service and request account deletion at any time. If you violate these Terms or pose a risk to the Service, we may suspend or terminate your account immediately and without notice.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be announced inside the app or by email. Continued use after the effective date constitutes acceptance of the new Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong as the court of first instance.
